FDA will continue to use its regulatory authorities around e-cigarettes and all tobacco products as part of its comprehensive plan on tobacco and nicotine regulation to protect kids and significantly reduce tobacco-related disease and death: https://go.usa.gov/xmvwA
In particular, FDA will continue its Youth Tobacco Prevention plan to prevent youth access to/appeal of flavored tobacco products like e-cigarettes, curb the marketing of products aimed at youth & educate kids about the dangers of tobacco products, esp. popular e-cigarettes.
Education is another critical part of FDA’s regulation of e-cigarettes. In Sept., FDA launched “The Real Cost” Youth E-Cigarette Prevention Campaign targeting ~10.7 million youth w/ hard-hitting ads on digital/social media & posters with prevention messages in 37K+ high schools.
FDA also took action against 15+ firms for selling e-liquids that resemble kid-friendly foods, such as juice boxes, cereal and candy; and advanced an investigation into whether companies are introducing new e-cigarettes in violation of premarket authorization requirements.
FDA’s regulations for e-cigarettes include: ➡️ No sales to persons under 18 ➡️ No free samples ➡️ No modified risk claims without FDA authorization ➡️ Required nicotine addiction warning label ➡️ Required companies to register and list products and report ingredients
Compliance and enforcement are cornerstones of FDA’s regulation of e-cigarettes. Since 2016, FDA has issued 8,100+ warning letters and 1,135+ fines to brick & mortar and online retailers for illegal sales of e-cigarettes, e-liquids and similar products to minors.
